Theirworld, Your Walk Terms and Conditions

Theirworld USA

We would like to thank you for your participation in Theirworld, Your Walk in support of Theirworld USA (the “Organization”).

As a volunteer fundraiser for Theirworld USA, we are happy for you to use the Organization logo for your preapproved fundraising projects, but please note that the logo cannot be used to promote anything other than your fundraising effort for the Organization through Theirworld, Your Walk. We would also love to hear about how your fundraising is going, so please send us updates, which we can feature on our website or in our newsletter.

Given your association with the Organization, please read the following statement and agree to the Terms and Conditions.

You must disclose by contacting [email protected] anything that could reasonably be expected to have an adverse effect on you or the Organization.

Terms and Conditions

  • Our commitment to you is that we help you with raising money through providing support and information about Theirworld, Your Walk.
  • We will provide you with the Organization branding. You may only use fundraising materials that you have a right to copy and use.
  • You are agreeing to endeavor to raise a minimum of $150.00 for Theirworld USA.
  • You are accepting that you are solely responsible for your own training for this.
  • When fundraising, you will act lawfully and follow the fundraising guidelines given by the Organization. You must make it clear you are fundraising in “aid of the Organization” and are not representing or acting on behalf of the Organization.
  • The event which you are registering for is physically challenging and may pose a risk of discomfort, illness, injury and even death. You hereby represent that you are physically capable of participating in the event without undue risk to your health or life. We do not conduct health or fitness checks on entrants and the responsibility for your ability to participate in the event is with you as the participant.
  • You must not do anything that may have an adverse effect on the reputation of the Organization, and if in our opinion you do, we will require that you stop fundraising for us.
  • We may use your name and any images we have of you from Theirworld, Your Walk in promotional materials and on our website. If you do not consent to the use of your name and images from the event, please notify us via email at [email protected].
  • How we manage your data: for information about how we may process your personal data and your rights in relation to this, please see our data privacy policy.
  • “Fundraise Up” is a separate data controller and therefore when you register with them as part of your participation in the Theirworld, Your Walk you should also review their privacy policy.  


Volunteer Waiver of Liability and Release

By agreeing to the Terms and Conditions, you (the “Volunteer”) agree to the Waiver of Liability (the “Waiver”) in favor of the Theirworld USA, a nonprofit corporation organized and existing under the laws of the State of Delaware and its directors, officers, employees and agents (collectively “the Organization”).

I, the Volunteer, for myself and my heirs, executors, administrators and assigns, hereby freely and voluntarily, without duress, execute this Waiver under the following terms:

  1. Waiver and Release. I, the Volunteer, hereby release and forever discharge and hold harmless the Organization and its successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from my volunteer work with the Organization. I understand and acknowledge that this Waiver discharges the Organization from any liability or claim that I, the Volunteer, may have against the Organization with respect to bodily injury, personal injury, illness, death, or property damage that may result from my service at the Organization or an Organization-sponsored event. I also understand that the Organization does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health or disability insurance, in the event of injury, illness, death or property damage.
  2. I, the Volunteer, understand that I expressly waive any such claim for compensation or liability on the part of the Organization beyond what may be offered freely by the representative of the Organization in the event of such injury or medical expense.
  3. Medical Treatment. I hereby release and forever discharge the Organization from any claim whatsoever which arises or may hereafter arise on account of such treatment or other medical services.
  4. Assumption of the Risk. I understand that my participation in the Event may include activities that may be hazardous to me, including, but not limited to, transportation to and from the Organization and the Organization-sponsored events and injuries that may be sustained during the Organization-sponsored events, such as lifting equipment. Notwithstanding the risk, I acknowledge that I am knowingly and voluntarily participating in the Event with an express understanding of the dangers involved and hereby expressly and specifically assume the risk of injury or harm in these activities and release the Organization from all liability for injury, illness, death, or property damage resulting from my participation in the Event, whether caused by the ordinary negligence of the Organization or any Releasees or otherwise.
  5. Photographic Release. I grant and convey unto the Organization all right, title, and interest in any and all photographic images and video or audio recordings made by the Organization during my participation in the Event, including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings.
  6. This Waiver constitutes the sole and entire agreement between the Organization and the Volunteer with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to such subject matter.I expressly agree that this Waiver is intended to be as broad and inclusive as permitted by the laws of the State of New York, and that this Waiver shall be governed by and interpreted in accordance with the laws of the State of New York, without giving effect to any choice or conflict of law provisions thereof to the extent such principles or rules would require or permit the application of the laws of any jurisdiction other than those in the State of New York. I agree that in the event that any clause or provision of this Waiver shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.

I ACKNOWLEDGE THAT I HAVE READ AND FULLY UNDERSTOOD ALL THE TERMS OF THIS RELEASE AND THAT I AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE ORGANIZATION.
